Today, 14 July, the European Commission decided to send reasoned opinions to Croatia (INFR (2022) 2164), Hungary (INFR (2022) 2165) and Romania (INFR (2022) 2166) for non-compliance with reporting obligations under Regulation (EU) 2018/1999 on the Governance of the Energy Union and Climate Action.

In particular, the Commission invites Croatia to report fully on the achievement of its 2020 energy efficiency targets and the share of renewable energy in the dedicated electronic platform.

The Commission urges Romania, Hungary and Croatia to report on the achievement of the 2020 targets. 

Today, 14 July, the European Commission decided to send reasoned opinions to Croatia (INFR (2022) 2164), Hungary (INFR (2022) 2165) and Romania (INFR (2022) 2166) for  non-compliance with reporting  obligations under Regulation (EU) 2018/1999 on the Governance of the Energy Union and Climate Action. In particular, the Commission invites Croatia to report fully on the achievement of its 2020 energy efficiency targets and the share of renewable energy in the dedicated electronic platform.

The Commission also requests Hungary and Romania to report exhaustively on the achievement of their 2020 energy efficiency targets. The Regulation on the Governance of the Energy Union and Climate Action sets out the requirement for Member States to report to the Commission by 30 April 2022 on the achievement of their 2020 energy efficiency targets set out in the Energy Efficiency RO••• Directive 2012/27/EU. The Governance Regulation also provided for Member States to report by the same deadline on their targets for the share of energy from renewable sources in 2020, as set out in Directive 2009/28/ECRO••• on the promotion of the use of energy from renewable sources.

In January 2023, the Commission sent a letter of formal notice to the three Member States. So far, despite partial progress, they have not submitted complete reports as required by the Regulation. These Member States now have two months to remedy the situation and fully comply with reporting obligations. Otherwise, the Commission may decide to refer the case to the Court of Justice of the European Union.

With its monthly package of infringement decisions, the European Commission (‘the Commission’) seeks to sue Member States that have failed to fulfil their obligations under EU law. These decisions, covering various EU sectors and policy areas, aim to ensure the proper application of EU law for the benefit of citizens and businesses.
