THE COMPETITION COUNCIL LAUNCHES INVESTIGATION INTO ELECTRICITY METER READING SERVICES IN ROMANIA
The Competition Council has launched an investigation into possible manipulations of public
tenders organized by certain contracting authorities/entities for the awarding of electricity
meter reading service contracts in Romania.
The competition authority has indications that the companies Andrem Strategy S.R.L. and
Electro Strategy S.R.L coordinated their commercial policies to share contracts in public
procurement procedures organized by entities such as Distributie Energie Electrică România,
E Distributie Muntenia, Distributie Energie Oltenia, Societatea de Distributie a Energiei
Electrice Transilvania Sud S.A., Societatea de Distributie a Energiei Electrice Muntenia Nord
S.A. and E-Distributie Banat S.A.
In this context, the Competition Council conducted dawn raids at the premises of the
companies involved in the investigation, as well as at Servelectro Integral S.R.L. and Serv H.R.
Integral S.R.L., due to their commercial links with Andrem Strategy S.R.L.
The documents collected are being analyzed by the Romanian competition authority as part
of the specific procedures.
Dawn raids are a crucial step in investigating potential anti-competitive behavior, but their
execution does not constitute a pre-judgment by the Competition Council regarding the
existence of a Competition Law violation.
The dawn raids were authorized by the Bucharest Court of Appeal and are justified by the
need to obtain all necessary information and documents to clarify the potential anticompetitive practices under review.
If the Competition Council determines that competition rules have been violated, the
companies involved could face fines of up to 10% of their turnover. However, companies that
cooperate with the competition authority under the leniency program may receive immunity
from fines or significant reductions in fines.
